- One order seeks to stop pregnant foreign nationals from travelling to the US to give birth so their babies become citizens, while the other targets automatic citizenship for specific groups.
- The administration argues that the new orders are narrower and address historical exceptions that were outside the scope of the Supreme Court’s ruling.
- Practical enforcement is unclear, while several advocacy groups and legal experts predict that the citizenship restrictions will fail in court; Stephen Miller considers them authorised under immigration law.
- There is no official figure for birth tourism, but the Migration Policy Institute estimates that about 26,000 of roughly 3.5 million annual US births might fall into that category.
No additional executive order can change the meaning of the Constitution. Any executive order that tries to rewrite birthright citizenship will meet the same fate as the last one.— Cody Wofsy, American Civil Liberties Union deputy director, said in a statement
