- A few days before the interview, Badenberg had commissioned a legal review of whether the Last Generation should be classified as a criminal organisation.
- On the same day, police searched homes of Last Generation members in seven German states and seized accounts and documents, including in Berlin.
- The Munich prosecutor’s office leading the operation initially described the group as a criminal organisation and later revised this to an initial suspicion, while Badenberg said in the interview that the Last Generation could not be classified that way as a whole and that only courts could decide the matter.
- Asked about a possible move by the activists underground, Badenberg said this was not her responsibility and had to be decided by the Last Generation itself.
Therefore it is necessary to exhaust all legal avenues, and that includes the question of whether the Last Generation constitutes a 'criminal organization'.— Felor Badenberg, Berlin's Justice Senator, in an ARD Tagesthemen interview
