- After more than 90 minutes of debate, the House passed House Bill 40 75–43, largely along party lines.
- Six Democrats, including Legislative Black Caucus members, supported it, creating the margin for a possible veto override if Governor Roy Cooper blocks it again.
- Amendments raised the property-damage threshold from $1,500 to $2,500 and reduced possible detention from 48 to 24 hours.
- Critics fear disproportionate enforcement against people of color; supporters, including Willingham, say the law would apply equally to everyone.
"What we found was, our current laws that are in place were not sufficiently strong enough, to guarantee that those who engaged in the most violent and destructive behavior, would ever see the inside of a jail cell," Moore said. "I thought that was unacceptable. I would submit to you that most North Carolinians would find that unacceptable."— Rep. Moore on the North Carolina House floor during debate on HB 40 (anti-riot bill)
