- The Tahltan Nation identifies 95,933 square kilometres as its territory, equivalent to about 11 per cent of British Columbia.
- British Columbia is negotiating an agreement with the Tahltan Nation and other groups to recognize Indigenous title, with greater control over boundaries and the local economy while government payments continue.
- Through new agreements under Section 7 of the Declaration on the Rights of Indigenous Peoples Act, the province has already transferred authority to the Tahltan over the proposed Eskay Creek Mine Revitalization project and the existing mine, and neither project can proceed without Tahltan consent.
- The authors compare the arrangement’s operation with sovereignty-association and argue that the Tahltan would have functional territorial sovereignty while remaining administratively and financially integrated with Canada, without an independent country being created.
